Legal Entity & Agreement to Terms

 


LowCountryFillDirt.com is a doing business as (DBA) name operated by Massive Transport SC LLC.

All sales, deliveries, and transactions made through this website are conducted by Massive Transport SC LLC.


By placing an order or making a purchase on LowCountryFillDirt.com, the customer acknowledges and agrees that they are doing business with Massive Transport SC LLC and agrees to all terms and conditions set forth below.

 

 

 

PROPERTY DAMAGE RELEASE

 


(Applies if delivery is requested inside the curb line)


It is the policy of Massive Transport SC LLC to guarantee delivery to the curb line only.


If the owner, homeowner, tenant, or any authorized representative requests or directs one of our trucks to enter the property beyond the curb line, the customer agrees that Massive Transport SC LLC shall not be responsible for:

 

  • Towing or recovery charges for trucks that become stuck off public roadways

  • Damage to lawns, driveways, sidewalks, buildings, parking lots, trees

  • Damage to underground utilities, septic systems, irrigation systems, or any other property

 


If a truck becomes stuck and it is necessary to drop or dump the load in order to safely free or recover the vehicle, the customer agrees to allow Massive Transport SC LLC to dump the material at the truck’s current location.


If Massive Transport SC LLC determines that the requested dump location is unsafe, unstable, or presents a risk of damage or injury, we reserve the right to dump the material in a safe location of our choosing.


The customer further agrees to pay all towing, recovery, or related charges incurred after our trucks leave public roadways.

 

 

 

CANCELLATION / REFUSAL OF DELIVERY

 


Once material has been loaded onto a truck, the load is considered accepted and non-cancelable.


If the owner, homeowner, or any representative refuses delivery, cancels, or changes their mind after material has been picked up, the customer agrees that:

 

  • The full hauling charge for the load is due and payable

  • Any standby time, return hauling, re-dumping, or disposal costs will be billed to the customer

  • Massive Transport SC LLC reserves the right to dump the material at a legal and safe location of our choosing

  • No refunds will be issued for loads already picked up or in transit

 

 

 

 

AUTHORITY CLAUSE

 


By placing an order through this website, the customer represents and warrants that they are the property owner or an authorized agent acting on behalf of the property owner and have full authority to authorize delivery and accept all terms, conditions, and liabilities on behalf of all owners and interested parties.
